Argued: February 27, 2003 As amended May 1, 2003 Petitioner appeals the judgment entered by the United States District Court for the District of Connecticut (Squatrito, J.). The District Court denied the petition for a writ of habeas corpus brought pursuant to 28 U.S.C. § 2241, reasoning that because petitioner's conviction of third degree assault in violation of section 53a-61 of the Connecticut General Statutes constituted a crime of violence as defined in 18 U.S.C. § 16(a), petitioner was removable as an aggravated felon under 8 U.S.C. § 1227(a)(2)(A)(iii). Reversed and remanded.
