Appeal and cross-appeal from an amended default judgment entered in the United States District Court for the Eastern District of New York (Mishler, J.) in favor of plaintiff for money owed pursuant to a credit agreement, the court having found that defendant had waived the defenses of improper service of process and lack of personal jurisdiction by appearing on a motion to vacate the original judgment on other grounds during the pendency of an appeal in the United States Court of Appeals for the District of Columbia Circuit challenging enforcement of the original judgment, which the D.C. Circuit ultimately held void for failure to complete proper service of process upon defendant as a foreign state.
